An unprecedented day in the history of California, as Justice Vaughn Walker released his decision on the heated Prop 8 trial today, around 1:45 pm PST, ruling in favor for the plaintiffs in the trial, thus annulling the highly contentious proposition which outlawed gay marriage in the State of California.

In a strongly worded 136 page ruling Walker declared that the state, “has no interest in differentiating between same-sex and opposite-sex unions.”

Walker based his decision on two key elements, first that the proposition was unconstitutional and second that the initiative was indeed fueled by anti-gay bias and prejudice. Walker contended, “the evidence shows conclusively that moral and religious views form the only basis for a belief that same-sex couples are different from opposite-sex couples.”

Jubilant gays across the nation praised the ruling, arguing that they are one step closer to full equality in the United States. Gays and their supporters argue that being denied marriage rights only confirms their inequality in our country and that Walker’s ruling thus sheds light onto some of the ignorance and condemnation they must daily endure.

As expected, the proponents of Prop 8 have appealed the ruling, calling Walker’s decision lamentable and a flagrant abuse of power. Tony Perkins of the Family Research Council stated that Walker acted on his own behalf and not on the behalf of the voters in the state.

(It is indeed ironic how these biased, anti-gay organizations often include the word family as part of their organization’s title, somehow washing them clean from accusations of discrimination and hatred as long as its for “the kids”. Clever indeed.)

Walker has placed a stay on the ruling until Friday however, thus still blocking gays from getting married in the state and allowing those in favor of Proposition 8 time to file the proper appeal to continue blocking gay’s right to marry in California.

The controversy is expected shortly to move on to the U.S. 9th Circuit Court of Appeals and then to the Supreme Court, where anti-gay marriage advocates hope to amend the U.S. Constitution and permanently ban gays from marrying in any State.

And the fight continues.
